Ruling on a debtor leading the prayer

 

Is it permissible for one who is debt to lead the people in prayer?.

Praise be to Allaah.

Yes, it is
permissible for one who is in debt to lead the people in prayer, if he is
fit to lead the prayer, because there is no evidence to suggest that it is
not allowed or it is makrooh for a debtor to lead the prayer, unless he is a
debtor who is delaying payment when he is able to pay off the debt, but he
is delaying it and trying to avoid it. In that case he is ruled to be a
faasiq (evildoer) and there is a difference of scholarly opinion concerning
the faasiq. 

The evidence that it is
haraam to delay paying off debts is the words of the Prophet (peace and
blessings of Allaah be upon him): “If one who can afford it delays
repayment, his honour and punishment become permissible.” Narrated by
al-Nasaa’i (4689), Abu Dawood (3628) and Ibn Maajah (2427); classed as hasan
by al-Albaani in Saheeh Abi Dawood. 

And the Prophet
(peace and blessings of Allaah be upon him) said: ““For a rich man to delay
repayment is wrongdoing.” Narrated by al-Bukhaari (2287) and Muslim (1564). 

Al-Shawkaani (may Allaah
have mercy on him) said: There is a difference of opinion as to whether
delaying payment when one is rich is a major sin or not. The majority of
scholars are of the view that it constitutes fisq (evildoing), but they
differed as to whether it makes one a faasiq if done once, or if that
depends on whether it is done repeatedly. And is it conditional upon the
demand for repayment being made or not? 

End quote from Nayl al-Awtaar (5/282). 

Among those who regarded
it as a major sin was Ibn Hajar al-Haythami in al-Zawaajir ‘an Iqtiraaf
al-Kabaa’ir (1/414). 

Among the fuqaha’ were
those who stated that the testimony of one who delays payment of a debt is
to be rejected, as is stated in al-Sharh al-Kabeer ‘ala Matn
Khaleel (4/181). 

Secondly: 

In the answer to
question no. 13465 we have explained the difference of opinion among the
scholars as to whether it is valid for a faasiq to lead the prayer, but they
are agreed that it is makrooh to pray behind him. 

Shaykh al-Islam Ibn
Taymiyah (may Allaah have mercy on him) said: The imamas are unanimously
agreed that it is makrooh to pray behind a faasiq, but they differed as to
whether it is valid. It was said that it is not valid, as was the view of
Maalik and Ahmad according to one of the two reports narrated from him. And
it was said that it is valid, as was the view of Abu Haneefah, al-Shafaa’i
and the other reports narrated from them. But they did not differ concerning
the fact that the faasiq should not be appointed as an imam.

Conclusion: 

If a man is poor and cannot afford to pay off a debt, this
does not detract from his religious commitment or good character, and it is
not valid to use this as a reason to prevent him from leading the prayers. 

But if he is able to pay off the debt but he is delaying it
with no excuse and taking too long to pay it off, then he should not be
appointed as an imam to lead the Muslims in prayer.

Is there any sin on him if he takes out a loan for someone else and he does not pay it off?

 

If a person takes out a loan in my name but the debt is not mine, rather it is for him, is there any sin on me if he does not pay it off?.

Praise be to Allaah.

What we
understand from your question is that you want to take out a loan in your
name, so that someone else may benefit from it, and this person may or may
not pay it off. In that case you will be expected, according to sharee’ah,
to pay off the loan because apparently you took it for yourself, and the
loan was given on that basis. 

If you know
that the borrower will never pay it off, then you should not help him to get
that loan, because by doing that he is a wrongdoer and aggressor who is
exposing himself to the punishment mentioned in the words of the Prophet
(peace and blessings of Allaah be upon him): “Whoever takes people’s
wealth intending to pay it back, Allaah will enable him to pay it back, and
whoever takes it intending to destroy it, Allaah will destroy him.” Narrated
by al-Bukhaari (2387). 

But if you
intend to pay it off for him if he refuses to pay it off, then there is
nothing wrong with that, and you will have done him a favour with this
money.  

To sum up:
So long as the loan is in your name, then according to sharee’ah you are
responsible for paying it off.

Removing pictures on children’s clothes

 

my wifes son has clothes witch has pictures on them .The majority of his cloths have images.If I throw them away he will have very littel cloths;however I want to follow the quran and sunnah to the best of my ability.Please give me sincer advice.

Allaah.

Pictures of animate beings must be removed
,whether they are on clothing or other items. They may be removed by
blotting them out. What is important is to erase the face by blotting
it out or by stitching a piece of fabric over it so that the face will
be obliterated. See also the answer to Question # 3332.

Bringing books that contain pictures into the mosque

 

What is the Islamic view on bringing text-books into the mosque in order to teach students from them, given that the final exams are approaching? Some of the text-books contain pictures and some of the teachers have refused to teach the students in the mosque because of these pictures.

It is not permissible, unless the faces and all
distinguishing features are erased, whether the picture is on the cover or
inside the book.

His parents admitted to him that he was conceived in zinaa. Whose name should he take?

 

My parents conceived me from zina.Whose name do I take and who are my people?

Praise be to Allaah. 

 We addressed this question to Shaykh
‘Abd-Allaah ibn Jibreen, who wrote back to us with the following
response:

 The correct view is that there is no sin on the
child of zinaa because of the sin of his parents, because he did not do
anything wrong. The (burden of) sin is on his parents. On this basis, he
can call himself after his father who has acknowledged his paternity, so
that he can prove that he belongs to him and his state (in official
papers). Or he can call himself after his mother who gave birth to him,
because this is his line of descent; then he will belong to her tribe and
state. He should also do righteous deeds and be upright in his conduct and
commitment to Islam. What his parents did should not cause him any harm. A
person who is hindered by his bad deeds will not be helped by his lineage
[i.e., a person’s origins do not count for anything if his actions are
bad]. And Allaah knows best.

He wants to repent from homosexuality and needs help

 

I am a very serious muslim who reverted to islam many years ago. i was sexually abused as a child and after that, i am attracted to males as well as females. it is something that i hate within myself, but i don't know how to change it. i don't commit the actual sin often, but i do it sometime. after i do it, i hate it as i know ALLAH hates such perversion. the problem is that i am unable to help myself. i try and try to change, but i am unable to change. i beg and continue to beg ALLAH for help. i have also confessed in front of muslims seeking help, and i have been in therapy. the main thing is that i love ALLAH and the sunnah, and everything else in my life reflects this love. i am constantly striving for the pleasure and nearness of ALLAH. please please please help me. since i am plagued with this sickness, i understand why the sharia mandates that death is the punishment for homosexuality. i am potentially big and serious problem within the ummah. as long as i am alive, i may commit this perversive act. all of my friends are ,uslim and all of them are serious muslims like me. the shaitan may whisper to us and use me to detroy me and a friend's iman. please help me. i am ready to go anywhere i need to go so that i can be subjected to the beautiful and complete sharia of ALLAH. i don't want to commit this sin anymore, and i don't want to be a threat to any of ALLAH's servants. please help me soon. i don't know where else to turn.

We will discuss four points with you and no
more than that, and we hope that you will read them carefully. These four points are: the abhorrent nature of the sin of homosexuality; the
damaging effects it has on health; the greatness of Allaah’s mercy to those who repent; and ways of dealing with this problem. 

1 – The abhorrent nature of the sin of
homosexuality 

Ibn al-Qayyim said concerning the people of
Loot: 

Those who support the first view – who are
the majority of the ummah, and more than one narrated that there was consensus among the Sahaabah on this point – said that there is no sin that
causes more corruption than the sin of homosexuality. It is second only to the sin of kufr, and may be greater than the sin of murder, as we shall
see below in sha Allaah. 

They said: Allaah did not test anyone with
this major sin before the people of Loot, and He punished them with a punishment that he did not send upon any other nation. He sent upon them
various kinds of punishment: they were destroyed, their houses were turned upside down, the earth swallowed them up, they were pelted with stones
from the sky, their eyes were blinded, they were tormented and their torment was made ongoing. So they were punished severely in a way that no
other nation was punished, and that was because of the evilness of this crime which almost causes the earth to shake when it is done on it; and
the angels flee to the ends of the heavens and the earth when they witness it, fearing that the punishment may come upon its people and strike
them too; and the earth cries out to its Lord, and the mountains almost collapse. 

Killing the one to whom it is done would be
better for him than having intercourse with him, for if a man has intercourse with him he corrupts him in such a way that life is no longer worth
living, unlike killing him in a real sense, in which case he would be a martyr who had been wronged, which may be of benefit to him in the
Hereafter. 

And he said: 

The companions of the Messenger of Allaah
(peace and blessings of Allaah be upon him) agreed unanimously that he should be put to death, and none of them disagreed about that. Rather
they differed with regard to the manner in which he should be put to death. Some of the people thought that the difference of opinion had to do
with whether [the homosexual] should be executed, and they narrated it as being a point of dispute among the Sahaabah, whereas in fact it was a
matter on which there was consensus. 

Whoever ponders the verse in which Allaah
says (interpretation of the meaning): 

“And come not near to unlawful sex.
Verily, it is a Faahishah (i.e. anything that transgresses its limits: a great sin, and an evil way that leads one to hell unless Allaah Forgives
him)”

[al-Isra’ 17:32] 

And the verse in which He says concerning homosexuality (interpretation of the meaning): 

“And (remember) Loot (Lot), when he said
to his people: “Do you commit the worst sin such as none preceding you has committed in the ‘Aalameen (mankind and jinn)?”

[al-A’raaf 7:80] 

will see a difference between the two. For
Allaah mentioned zina without the definite article, indicating it is a kind of evil action, but He mentioned homosexuality (liwaat) with the
definite article al-, which means that it encompasses all aspects of faahishah or evil.   

Then Allaah confirms that and states that no
one in the ‘aalameen (mankind and jinn) ever did this before them, as He says, “such as none preceding you has committed
in the ‘Aalameen (mankind and jinn)”. Then He emphasizes that even further by mentioning it a blunt manner that
demonstrates the abhorrent nature of this action, which is a man having intercourse with a man as a man has intercourse with a woman, and He says
(interpretation of the meaning): 

“Verily, you practise your lusts on men
instead of women”

[al-A’raaf 7:81] 

Then Allaah confirms how abhorrent that is by stating that the homosexuals distort the nature
with which Allaah has created men, which is to desire women rather than men. They have twisted the natural order and they approach men with desire
rather than women. Hence Allaah turned their houses upside down and their hearts likewise, and they were turned upside down, as a punishment. 

Then Allaah reiterated the abhorrence of
their actions by judging them to have transgressed all bounds as He says (interpretation of the meaning): 

“Nay, but you are a people transgressing
beyond bounds (by committing great sins)”

[al-A’raaf 7:81] 

Think about this: was this, or anything similar, said concerning adultery? And Allaah
reiterated the abhorrent nature of their action when He said (interpretation of the meaning): 

“and We saved him from the town (folk) who
practised Al‑Khabaa’ith (evil, wicked and filthy deeds)”

[al-Anbiya’ 21:74] 

Then Allaah the All-Knowing condemned them
further by describing them as being extremely evil, as He said (interpretation of the meaning): 

“Verily, they were a people given to evil,
and were Faasiqoon (rebellious, disobedient to Allaah)”

[al-Anbiya’ 21:74] 

And He described them as mufsidoon
(evildoers etc), as He said (interpretation of the meaning): 

“My Lord! Give me victory over the people
who are Mufsidoon (those who commit great crimes and sins, oppressors, tyrants, mischief‑makers, corrupters).”

[al-‘Ankaboot 29:30]  

And He called them zaalimoon
(wrongdoers), in the words that the angels said to Ibraaheem (peace be upon him) (interpretation of the meaning): 

“Verily, we are going to destroy the
people of this [Loot (Lot’s)] town (i.e. the town of Sodom in Palestine); truly, its people have been Zaalimoon [wrongdoers, polytheists
disobedient to Allaah, and belied their Messenger Loot (Lot)]”

[al-‘Ankaboot 29:31] 

Think about those who have been punished in
these ways, and whom Allaah has condemned in such terms. 

And he said: 

Pleasure ceased and was followed with loss;
desires ended and led to misery; they enjoyed themselves for a little while, but will be punished for a long time. They grazed on filth, and they
suffer a painful torment. They were intoxicated with those desires, but they have awoken in the abode of the tormented. They feel the greatest
regret, by Allaah, at the time when regret is to no avail. They weep for what they did before, with tears of blood. If only you could see the
highest and lowest of this group, with fire coming out from their faces and bodies when they are in the depths of Hell, drinking cups of boiling
water instead of delightful drinks, being told as they are being dragged on their faces, “Taste of that which you used to earn.” 

“Taste you therein its heat and whether
you are patient of it or impatient of it, it is all the same. You are only being requited for what you used to do”

[al-Toor 52:16 – interpretation of the
meaning]

2 – The damaging effects it has on health: 

Dr Mahmoud al-Hijaazi said in his book al-Amraad
al-Jinsiyyah wa’l-Tanaasuliyyah (Sexual and genital diseases), when discussing some of the dangers to health caused by committing sodomy: 

The diseases which are transmitted by way of sexual perversion (homosexuality) are: 

1.    
AIDS, which causes loss of acquired immunity and usually leads to death.

2.    
Viral inflammation of the liver

3.    
Syphilis

4.    
Gonorrhea

5.    
Herpes

6.    
Bacterial inflammation of the anus

7.    
Typhoid

8.    
Amoebiasis

9.    
Intestinal worms

10.
Anal warts

11.
Scabies

12.
Pubic lice (“crabs”)

13.
Cytomegalovirus that may lead to anal cancer

14.
Genital-lymphatic pustules  

3 – The greatness of Allaah’s mercy to those
who repent 

From the above it is clear that this immoral
action is seriously wrong and abhorrent, and leads to harmful consequences. Nevertheless the door is open for sinners to repent, and Allaah
rejoices at their repentance. 

Think about what Allaah says (interpretation
of the meaning): 

“And those who invoke not any other ilaah
(god) along with Allaah, nor kill such person as Allaah has forbidden, except for just cause, nor commit illegal sexual intercourse and whoever does this shall
receive the punishment.

The torment will be doubled to him on the
Day of Resurrection, and he will abide therein in disgrace;

Except those who repent and believe (in
Islamic Monotheism), and do righteous deeds; for those, Allaah will change their sins into good deeds, and Allaah is Oft‑Forgiving, Most Merciful”

[al-Furqaan 25:68-70] 

By thinking about the words, “Allaah will
change their sins into good deeds”, you will see how great is the bounty of Allaah the Almighty. 

The scholars said that there are two meanings
of the word “change”: 

(i)               
Bad attributes will be turned into good attributes, such as their shirk being turned
into faith, their adultery into chastity, their lying into honesty, their treachery into trustworthiness, and so on.

(ii)             
The bad deeds that they have done will be turned into good deeds on the Day of Resurrection. 

So what you must do is repent to Allaah and
know that your coming back to Him is better for you and your family and your brothers and the entire society. 

Remember that life is short, and that the
Hereafter is better and more lasting. Do not forget that Allaah destroyed the people of Loot in a way that He did not destroy any other nation. 

4 – Ways of dealing with this problem 

(i)               
Keeping away from the things that make it easy for you to fall into this sin and
remind you of it, such as:

-        
Letting your gaze wander and looking at women or movies

-        
Being alone with any man or woman 

(ii)             
Always keeping yourself busy with things that will benefit you in your religious or worldly
affairs, as Allaah says (interpretation of the meaning):

“So when you have
finished (your occupation), devote yourself for Allaah’s worship”

[al-Sharh 94:7]

So when you have
finished with some worldly task, then strive to do something that will benefit you in the Hereafter, such as remembering Allaah (dhikr), reading
Qur’aan, seeking knowledge, listening to useful tapes, etc.

When you finish one act of worship then start another, and if you finish one worldly task
then start another… and so on, because if you do not keep your nafs (self) busy with good things, it will keep you busy with bad things. So do not
give your nafs any opportunity or spare time to think about this evil action. 

(iii)           
Compare the pleasure you feel when committing this sin with the regret, anxiety and confusion that
follow it and stay with you for a long time, and then the torment that awaits the one who does that in the Hereafter. Do you think that any wise
man would give precedence to this pleasure which vanishes after an hour over the regret and torment that follow? You can become more convinced of
this if you read the book by Ibn al-Qayyim, al-Jawaab al-Kaafi li man sa’ala ‘an al-Dawa’ al-Shaafi. He wrote it for people in a situation
like yours. May Allaah make things easy for us and for you.  

(iv)           
The wise man does not give up a thing that he loves except for something that he loves more, or for
fear of something he dislikes. This evil action will cause you to lose the blessings of this world and the Hereafter, to lose Allaah’s love for
you, and will incur the anger, wrath and punishment of Allaah. 

Compare the good you
will lose and the evil that will come to you because of this evil action. The wise man will see which should take precedence. 

(v)             
More important than all of the above is making du’aa’ and seeking the help of Allaah to ward off
this evil from you. Make the most of the times and situations in which prayers are answered, such as sujood (prostration), before the tasleem at
the end of prayer, the last third of the night, when it is raining, when travelling, when fasting, and when breaking the fast. 

We ask Allaah to guide you and to accept your
repentance, and to help you to avoid bad deeds and bad attitudes.

I was a very modern girl until I met my
husband who brought me to Islam alhamdulilah. I was a zaniya and I never thought it was
that bad! this is making me have sleepless nights (which I sometimes spend praying to
Allah)and no matter how much I do I feel Allah will not forgive me for the many sins! I
got pregnant from my husband when we were still engaged ! the child is 7 now! is he a
"Child from Zina" will I ever be forgiven!

Praise be to Allaah.

Firstly, whoever repents, Allaah accepts his or her repentance.

Secondly, if the pregnancy and birth happened before the marriage
contract took place according to sharee’ah, the child takes the adulterous
mother’s name, not the adulterous father’s. The child still has rights according
to sharee’ah and he should be given a good upbringing and cared for properly.

Thirdly, you should not despair of the mercy of Allaah or say
“Allaah will not forgive me.” “No one despairs of Allaah’s soothing
mercy except those who have no faith” [Yoosuf 12:87 – interpretation of the
meaning]; “And who despairs of the mercy of his Lord, but such as go astray?”
[al-Hijr 15:56 – interpretation of the meaning]. So long as you have repented,
you should have the hope of mercy from Allaah.

Fourthly, you will find a detailed answer about repentance from zinaa
and a lot of information to make you feel better, in the book “"I
Want to Repent, But...", which is published in the

Fifthly, what is in the past can be dealt with by
repenting. From now on you have to try to do a lot of good deeds, because good deeds wipe
out bad deeds and raise a person’s status. We ask Allaah to forgive your sins and
help you adhere firmly to His religion. We wish you a future filled with good deeds and
acts of worship. May Allaah bless our Prophet Muhammad,

Can those who have committed homosexual acts be forgiven, and is it permissible for such a person to get married?

 

Could inform me regarding the Islamic view
about people who have committed homosexual acts, but have repented and abstained from such
acts. Should they be stoned to death? Can they be forgiven? And are they allowed to marry
people of the opposite gender?

Praise be to Allaah.

Undoubtedly the sin of homosexuality is one of the worst
sins; indeed, it is one of the major sins (kabaa’ir) that Allaah has forbidden.
Allaah destroyed the people of Loot (peace be upon him) with the most terrifying kinds of
punishment because they persisted in their sin and made this evil action commonplace and
acceptable among themselves. Allaah says (interpretation of the meaning):

“So when Our Commandment came, We turned (the towns of Sodom in
Palestine) upside down, and rained on them stones of baked clay, in a well-arranged manner
one after another; Marked from your Lord” [Hood 11:82-83].

Then Allaah says, warning those who come after them of the nations who
do the same deed as they did (interpretation of the meaning):

“and they are not ever far from the Zaalimoon (polytheists,
evildoers)” [Hood 11:83]

And Allaah says (interpretation of the meaning):

“And they indeed sought to shame his guest (by asking to commit
sodomy with them). So We blinded their eyes (saying), ‘Then taste you My Torment and
My Warnings.’” [al-Qamar 54:37]

The Prophet
(peace and blessings of Allaah be upon him) said:
“Whoever you find doing the action of the people of Loot, kill them, the one who does
it and the one two whom it is done.” (Narrated by Ahmad, 2727; classed as
saheeh by al-Albaani in Saheeh al-Jaami’ al-Sagheer wa Ziyaadatihi, no. 6589).

Imaam Ibn al-Qayyim (may Allaah have mercy on him) said:

It was reported that the Prophet
(peace and blessings of Allaah be
upon him) said: “Kill the one who does it and the one to whom it is done.” (Reported
by the four authors of Sunan. Its isnaad is saheeh. At-Tirmidhi said it is a hasan
hadeeth).

Abu Bakr al-Siddeeq judged in accordance with this, and
he wrote instructions to this effect to Khaalid, after consulting with the Sahaabah.
‘Ali was the strictest of them with regard to that. Ibn al-Qasaar and our shaykh
said: the Sahaabah agreed that [the person who does homosexual acts] should be killed, but
they differed as to how he should be killed. Abu Bakr al-Siddeeq said that he should be
thrown down from a cliff. ‘Ali (may Allaah be pleased with him) said that a wall
should be made to collapse on him. Ibn ‘Abbaas said, they should be killed by
stoning. This shows that there was consensus among them that [the person who does
homosexual acts] should be killed, but they differed as to how he should be executed. This
is similar to the ruling of the Prophet
(peace and blessings of Allaah be upon him)
concerning the person who has intercourse with a woman who is his mahram [incest], because
in both cases intercourse is not permitted under any circumstances. Hence the connection
was made in the hadeeth of Ibn ‘Abbaas (may Allaah be pleased with him) who reported
that the Prophet
(peace and blessings of Allaah be upon him) said, “Whoever you find
doing the deed of the people of Loot, kill them.” And it was also reported that he

(peace and blessings of Allaah be upon him) said: “Whoever has intercourse with a
woman who is his mahram, kill him.” And according to another hadeeth with the same
isnaad, “Whoever has intercourse with an animal, kill him and kill the animal with
him.” (Narrated by Ahmad, 2420; Abu Dawood, 4464; al-Tirmidhi, 1454;
al-Haakim, 4/355).

This ruling is in accordance with the ruling of
sharee’ah, because the worse the haraam action is, the more severe the punishment for
it. Having intercourse in a manner that is not permissible under any circumstances is
worse than having intercourse in a manner which may be permitted in some circumstances, so
its punishment is more severe. This was stated by Ahmad in one of the two reports narrated
from him. (Zaad al-Ma’aad, part 5, p. 40-41).

The same applies to the sin of lesbianism. There is no
doubt among the fuqahaa’ that lesbianism is haraam and is a major sin, as stated by
al-Haafiz Ibn Hajar (may Allaah have mercy on him). (Al-Mawsoo’ah
al-Fiqhiyyah, part 24, p. 251).

With regard to the specific type of punishment mentioned
in the question – stoning to death – this kind of punishment is for the
adulterer who is married. The shar’i punishment for the crime of homosexuality is
execution – by the sword, according to the most correct view – as was narrated
in the discussion above about the differences among the scholars as to how this execution
should be carried out. As far as lesbianism is concerned, there is no hadd for it, but it
is subject to ta’zeer [unspecified punishment to be determined at the
discretion of the qaadi]. (al-Mawsoo’ah al-Fiqhiyyah, part 24, p. 253).

But if the person who does this evil deed, or any other
action which is subject to a hadd punishment, repents, gives up that sin, seeks
forgiveness, regrets what he has done and intends never to go back to it – Shaykh
al-Islam Ibn Taymiyah (may Allaah have mercy on him) was asked about that, and he
answered:

If he truly repents to Allaah, Allaah will accept his repentance, and
he does not need to confess his sin to anyone so that the hadd punishment would be carried
out on him.

(Majmoo’ al-Fataawaa, part 34, p. 180).

Allaah says (interpretation of the meaning):

“And those who invoke not any other ilaah (god) along with
Allaah, nor kill such person as Allaah has forbidden, except for just cause, nor commit
illegal sexual intercourse ¾ and whoever does this shall
receive the punishment. The torment will be doubled to him on the Day of Resurrection, and
he will abide therein in disgrace; Except those who repent and believe (in Islamic
Monotheism), and do righteous deeds; for those, Allaah will change their sins into good
deeds, and Allaah is Oft-Forgiving, Most Merciful. And whosoever repents and
does righteous good deeds; then verily, he repents towards Allaah with true
repentance” [al-Furqaan 25:69-71].

If he repents sincerely towards Allaah, there is no reason why he
should not get married, and indeed it may be obligatory in his case, as a protection for
him and in accordance with what Allaah has permitted. And Allaah knows best. May Allaah

What is the difference between the thief (saariq, one who breaks in by stealth and steals something that is kept in an appropriate place) and the robber (muntahib, one who takes something by force in front of others)? Why is the hand cut off in the first case and not in the second?

be to Allaah.  

 

Ibn al-Qayyim said: 

The fact that the hand of the thief (saariq) may
be cut off for three dirhams, and not in the case of the opportunist
thief (mukhtalis, one who steals when a person is not looking),
robber or extortioner (ghaasib, one who seizes something by force)
is indicative of the perfect wisdom of sharee’ah. For one cannot take
precautions against the thief who breaks into houses and breaches one’s
hiding-places and breaks locks; the owner of the goods cannot do any
more than that (i.e., hiding them in appropriate places). If it were
not prescribed for the hand of the thief to be cut off, then people
would steal from one another in this manner and a great deal of harm
would be done, and the problem of theft would be grievous indeed. This
is unlike the case of the robber and opportunist thief, for the robber
is the one who takes things openly in the sight of people, so they may
stop him and restore the rights of the one who has been wronged, or
they may testify before the judge. And the opportunist thief is the
one who takes things when the owner is not paying attention, etc., so
there has to be some form of negligence which enables the opportunist
to steal, otherwise when one is careful and alert, he cannot take anything.
So he is not like a thief (saariq), rather he is more like a
betrayer.  

Moreover, the opportunist theif (mukhtalis) does
not take things from a place where things of that nature are usually
hidden, rather he waits until you are not paying attention, then he
takes your things when you put something down for a moment and are not
paying attention. This is something against which precautions may be
taken in most cases, and he (the opportunist) is like the robber who
steals openly. With regard to the one who seizes things by force, the
case is more obvious: it is even more apt that his hand should not be
cut off, but it is permissible to put a stop to the actions of these
people by beating them, making an example out of them as a warning to
others, imprisoning them for lengthy periods and punishing them by seizing
their property.

Will Allaah punish women who make a wanton display of their beauty (tabarruj)?

 

My question is about the grave sinners, we believe that his/her matter is up to Allah, if Allah wills He will punish or forgive them. But the hadeeth in which the prophet, peace be upon him says: “there are two types of people I have not seen, (until he mentions), and women who are clothed yet naked, they will not enter paradise or even smell its fragrance” this hadeeth was explained by imam an-nawawi, may Allah have mercy on him, as follows: 


If they do what they do believing it is not haram, then they will never enter paradise. Or they may be punished in hell first then they will enter paradise. 


This means they will definitely be punished first and they are of evil doers, is it possible that they might not be punished?.

Praise be to Allaah.

According to Muslim belief, the one who commits a major sin
is in grave danger and has exposed himself to the punishment of Allaah, but
the will of Allaah is to decide, and Allaah may forgive or pardon him, or He
may punish him in a manner commensurate with his sin, except for the one
whose sin reaches the level of disbelief in Allaah. In that case he will
deserve to be punished and to abide forever in Hell. 

Shaykh al-Islam Ibn Taymiyah was asked – as it says in
Majmoo’ al-Fataawa (11/646) – about women who pile their hair on top of
their heads, and they will not see Paradise or smell its fragrance. But it
is narrated in the hadeeth from the Messenger of Allaah (peace and
blessings of Allaah be upon him): “Whoever says La ilaaha ill-Allaah will
enter Paradise.” 

He replied:

It is proven in Saheeh Muslim and elsewhere from Abu
Hurayrah that the Prophet (peace and blessings of Allaah be upon him)
said: “There are two types of the people of Hell whom I have not seen: men
with whips like the tails of cattle with which they strike the people, and
women who are clothed but naked, walking with an enticing gait, with
something like the humps of camels on their heads. They will not enter
Paradise nor even smell its fragrance, and its fragrance can be smelled from
such and such a distance.”

Whoever claims that this hadeeth is not saheeh and that what
it mentions of the severe punishment is not true is ignorant and has gone
astray from the path of sharee’ah, and he deserves a punishment that will
deter him and other ignorant people like him who object to the saheeh
ahaadeeth that are soundly narrated from the Messenger of Allaah (peace
and blessings of Allaah be upon him). 

There are many saheeh ahaadeeth about this warning. For
example: 

“Whoever kills a mu’aahid unlawfully will not smell the
fragrance of Paradise, although its fragrance may be detected from a
distance of forty years.” 

“No one will enter Paradise in whose heart is a mustard
seed’s worth of arrogance.” 

“There are three to whom Allaah will not speak on the Day of
Resurrection nor will He praise them, and their will be a painful torment:
an old man who commits zina, a king who tells lies and a poor man who is
arrogant.” 

There are verses in the Qur’aan which speak of this warning,
such as the verse in which Allaah says (interpretation of the meaning):  

“And whosoever disobeys Allaah and His Messenger (Muhammad
صلى الله عليه وسلم), and transgresses
His limits, He will cast him into the Fire, to abide therein; and he shall
have a disgraceful torment”

[al-Nisa’ 4:14] 

This is something on which the Muslims are agreed, that the
warning in the Qur’aan and Sunnah to those who commit major sins is true,
but Allaah has stated in the Qur’aan and the Sunnah of His Messenger
(peace and blessings of Allaah be upon him) that the warning mentioned in
the Qur’aan and Sunnah does not apply to the one who repents, as He says
(interpretation of the meaning): “Say: O ‘Ibaadi
(My slaves) who have transgressed against themselves (by committing evil
deeds and sins)! Despair not of the Mercy of Allaah, verily, Allaah forgives
all sins. Truly, He is Oft‑Forgiving, Most Merciful”

[al-Zumar 39:53]

i.e., to the one who repents. 

In another verse Allaah says (interpretation of the meaning):

“Verily, Allaah forgives not that partners should be set
up with Him (in worship), but He forgives except that (anything else) to
whom He wills” [al-Nisa’ 4:48]. 

This applies to the one who does not repent. Shirk will not
be forgiven, but with regard to anything less than shirk, if Allaah wills He
will forgive and if He wills He will punish for it. 

In al-Saheehayn it is narrated that the Prophet
(peace and blessings of Allaah be upon him) said: “No tiredness, exhaustion,
worry, grief, distress or harm befalls a believer in this world, not even a
thorn that pricks him, but Allaah expiates some of his sins thereby.” 

Hence when the verse (interpretation of the meaning):
“whosoever works evil, will have the recompense thereof” [al-Nisa’ 4:123]
was revealed, Abu Bakr said: O Messenger of Allaah, this is going to destroy
us; who among us has not done evil? He said: “O Abu Bakr, do you not get
tired? Do you not grieve? Do you not go through hardship? That is part of
the recompense.”  

By means of calamities in this world, Allaah expiates the
sins of the believers that may be expiated by means thereof, and the same
applies to the good deeds that he does. Allaah says (interpretation of the
meaning): “Verily, the good deeds remove the evil deeds” [Hood 11:114].
And the Prophet (peace and blessings of Allaah be upon him) said: “The
five daily prayers, from one Jumu’ah to the next, and one Ramadaan to the
next, are expiations for whatever (of minor sins) come in between them, so
long as one avoids major sins.” And Allaah does not wrong His slaves in the
slightest, as He says (interpretation of the meaning): 

“So whosoever does good equal to the weight of an atom (or
a small ant) shall see it.

8. And whosoever does evil equal to the weight of an atom
(or a small ant) shall see it”

[al-Zalzalah 99:7-8]. 

So the warning may be cancelled out, either by means of
repentance, or by means of good deeds that one does which are equal to the
bad deeds, or by means of calamities through which Allaah expiates sins, or
by other means. End quote. 

Hence the scholars interpreted every verse or hadeeth the
apparent meaning of which is that those who commit major sins will abide
forever in Hell in ways that are in accordance with other texts of the
Qur’aan and Sunnah. 

Al-Nawawi (may Allaah have mercy on him) said in Sharh
Muslim (17/191): 

The words of the Prophet (peace and blessings of Allaah
be upon him), “will not enter Paradise” may be interpreted in two ways: 

(i)

They may be interpreted as referring to the one who regards
what is haraam as permissible, despite knowing that it is haraam; so she is
a kaafir who will abide forever in Hell and will never enter Paradise. 

(ii)

It may be interpreted as meaning that she will not enter it
at first along with those who are successful. End quote. 

It says in Fataawa al-Lajnah al-Daa’imah (2/27): 

Question: is it permissible for us to believe that the women
who are clothed yet naked are kaafirs, because the Prophet (peace and
blessings of Allaah be upon him) said, “They will not enter Paradise nor
will they smell its fragrance…”? 

Answer: 

Those who believe that it is permissible after being told
about the ruling and having it explained to them may be regarded as kaafirs.
Those who do not regard it as permissible but still go out clothed yet naked
are not kaafirs, but they are committing a major sin and they have to give
it up and repent to Allaah from that, in the hope that Allaah may forgive
them. If a woman dies in that state without having repented to Allaah, then
she is subject to the will of Allaah, like all those who commit sin, because
Allaah says (interpretation of the meaning):

“Verily, Allaah forgives not that partners should be set
up with Him (in worship), but He forgives except that (anything else) to
whom He wills” [al-Nisa’ 4:48]. End quote. 

It also says (17/104): 

Those women who regard that type of dressing as permissible
are kaafirs who will abide forever in Hell if they die in that state, and
they will not enter Paradise or smell its fragrance. If they wear that type
of clothing even though they believe it is haraam, then they are committing
a major sin, but that does not put them beyond the pale of Islam, and they
are subject to the will of Allaah: if Allaah wills He will forgive them and
if He wills He will punish them for the bad deeds they have committed, and
they will not enter Paradise or smell its fragrance until after they have
been punished first. 

This is the view of Ahl al-Sunnah, which reconciles the texts
which speak of promise with those which speak of warning. This is the middle
path between the views of the Murji’is, Khawaarij and Mu’tazliah. 

Shaykh Ibn Baaz said in Majmoo’ al-Fataawa (6/356): 

With regard to the words of the Prophet (peace and
blessings of Allaah be upon him), “they will not enter Paradise nor smell
its fragrance”, this is a stern warning, but that does not imply that they
are kaafirs, and they will not abide forever in Hell; this applies to all
sinners who die as Muslims. Rather they and other sinners are all given the
threat of Hell for their sins, but they are subject to the will of Allaah:
if He wills He will pardon them and forgive them, and if He wills He will
punish them, as He said in two places in Soorat al-Nisa’: “Verily, Allaah
forgives not that partners should be set up with Him (in worship), but He
forgives except that (anything else) to whom He wills” [al-Nisa’ 4:48]. 
The sinner who enters Hell will not abide therein forever as is the case
with the kaafir; rather those who are meant to abide there forever – such as
the murderer, adulterer and one who committed suicide – their abiding
therein is not the same as that of the kuffaar, rather it is an abiding that
will come to an end, according to Ahl al-Sunnah wa’l-Jamaa’ah, unlike the
Khawaarij and Mutazilah and those innovators who followed in their
footsteps. The mutawaatir saheeh ahaadeeth from the Messenger of Allaah
(peace and blessings of Allaah be upon him) indicate that he (peace and
blessings of Allaah be upon him) will intercede for the sinners among his
ummah, and that Allaah will accept his intercession several times, and each
time He will stipulate a number for him and he will bring them forth from
Hell. The same applies to the rest of the Messengers, believers and angels –
all of them will intercede by His leave and He will accept their
intercession for whomever He wills of the people of Tawheed who entered Hell
because of their sins and are Muslims. Then there will remain in Hell the
rest of the sinners who were not included in the intercession of the
intercessors, but Allaah will bring them out by His mercy and kindness, and
there will be no one left in Hell but the kuffaar who will abide therein
forever and ever, as Allaah says concerning the kuffaar (interpretation of
the meaning): 

“whenever it abates, We shall increase for them the
fierceness of the Fire”

[al-Isra’ 17:97] 

“So taste you (the results of your evil actions). No
increase shall We give you, except in torment”

[al-Naba’ 78:30] 

And He says concerning the kuffaar who worship idols
(interpretation of the meaning):

“Thus Allaah will show them their deeds as regrets for
them. And they will never get out of the Fire”

[al-Baqarah 2:167] 

“Verily, those who disbelieve, if they had all that is in
the earth, and as much again therewith to ransom themselves thereby from the
torment on the Day of Resurrection, it would never be accepted of them, and
theirs would be a painful torment”

[al-Maa’idah 5:36] 

“They will long to get out of the Fire, but never will
they get out therefrom; and theirs will be a lasting torment”

[al-Maa’idah 5:37] 

And there are many similar verses. We ask Allaah to keep us
safe and sound from being like them. End quote. 

To sum up, the woman who makes a wanton display of herself
(tabarruj), despite the fact that she is exposing herself to a painful
punishment from Allaah, is still subject to the will of Allaah: He may
forgive her and not punish her, or He may subject her to a painful
punishment. Moreover, some of the believers who commit sins will inevitably
enter Hell, as is mentioned in the mutawaatir ahaadeeth.

She is three weeks pregnant and her husband is threatening her with divorce if she does not abort the foetus

 

I am a young Moroccan woman, married with two children. My question is: I am three weeks pregnant despite taking precautions to not get pregnant at my husband’s request. As soon as I told him about the pregnancy he rejected it completely and threatened to divorce me if I do not abort this child. I hope that you can help me. Thank you.

A number of scholars are of the view that it is permissible
to abort the nutfah before forty days, as has been explained in the answer
to question no. 115954. 

Some of them limited it to cases where that serves an
interest or wards off harm, as is mentioned in a statement of the Council of
Senior Scholars, the text of which is as follows: 

1 – It is not permissible to abort the pregnancy at various
stages unless there is a shar’i justification for doing so, and within very
narrow limits. 

2 – If the pregnancy is in the first trimester, which is
forty days, and there is a legitimate purpose to be served by aborting it or
harm can be warded off thereby, then it is permissible to abort it. As for
aborting it during this period just because one fears hardship in raising
children or one fears being unable to afford the expenses of feeding them
and educating them, or because of their future, or because the couple are
happy with the number of children they have, that is not permissible. End
quote from al-Fataawa al-Jaami’ah (3/1055). 

Based on that, if you are afraid that your husband will
divorce you if the pregnancy continues, and he is serious about that, then
there is no sin on you if you abort the foetus within the first forty days
of the pregnancy. 

Shaykh Muhammad ibn Ibraaheem (may Allaah have mercy on him)
said: From what we have seen above, it is seems that it is permissible to
abort the nutfah. The evidence and reasons for that are clear. 

As for the period in which it is permissible to abort the
nutfah, it is forty days. End quote from Fataawa al-Shaykh Muhammad ibn
Ibraaheem (11/125).
